PRIVACY SHIELD NOTICE

Logi-Serve, LLC. ('Logi-Serve') complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. Logi-Serve has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. This Privacy Shield Notice describes how Logi-Serve collects, uses, and discloses certain personally identifiable information that we receive in the US from the European Economic Area ('EEA') and Switzerland ('Personal Data'). If there is any conflict between the terms in this Privacy Shield Notice and Logi-Serve’s Privacy Policy, the Privacy Shield Notice shall govern. If there is any conflict between the terms in this Privacy Shield Notice and the Privacy Shield Principles ('Principles'), the Principles shall govern. We reserve the right to amend this notice from time to time consistent with the Privacy Shield’s requirements.

Principles protecting individuals' privacy notice and choice

We collect and process personal data on behalf of our clients for the purpose of rendering professional services to our clients. We notify individuals about the personal data we collect from them, how we use it and how to contact us with privacy concerns. We provide such notice through this statement, through various instructional material and statements within our products, and direct communication with individuals from whom we collect personal data. Logi-Serve collects personal data from individuals only as permitted by the Privacy Shield Program. Consent for personal data to be collected, used, and/or disclosed in certain ways (including opt-in consent for sensitive data) is required in order for an individual to use our products or services. Such consent is provided through our professional services agreements with client organizations that utilize our products and services and through any product entry portals and/or registration pages.

Personal Data Collection and Use

We may receive the following categories of Personal Data in the US: name, email address, phone number, employment related information, login credentials to access the customer portal on the Site, and IP address. The information collected on the Site and through our Products may be used: (i) to communicate with you and process your inquiries; (ii) to process your responses while using the Products and send results and reports to the Organization for the purpose of human resources administration and recruitment following the Privacy Shield Program; (iii) to resolve technical problems with the Site and/or Products; (iv) to otherwise operate, maintain, and improve the Site and/or Products; (v) to protect, investigate, and deter against fraudulent, unauthorized, or illegal activity; (vi) to market and advertise our products and services to Consumer Website Users; (vii) to customize your user experience; or (viii) for research and statistical analysis. Logi-Serve will only process Personal Data in ways that are compatible with the purpose that Logi-Serve collected it for, or for purposes the individual later authorizes. Before we use your Personal Data for a purpose that is materially different than the purpose we collected it for or that you later authorized, we will provide you with the opportunity to opt out. Logi-Serve maintains reasonable procedures to help ensure that Personal Data is reliable for its intended use, accurate, complete, and current.

Disclosures and Data Transfers to Third Parties

We do not disclose an individual's personal data to third parties, except when one or more of the following conditions is true:
  • We have the individual's permission to make the disclosure.
  • The disclosure is required by lawful request by public authorities, including to meet national security or law enforcement requirements. Logi-Serve is also subject to the authority of the Federal Trade Commission.
  • The disclosure is required by law or mandatory professional standards. The disclosure is reasonably related to the sale or other disposition of all or part of our business.
  • The information in question is publicly available.
  • The disclosure is reasonably necessary for the establishment of legal claims.
  • The disclosure is to the client organization utilizing our products or services (each a "transferee"), consistent with the purpose for which the information was obtained, if the transferee, with respect to the information in question: Is subject to law providing an adequate level of privacy protection; or has agreed to provide an adequate level of privacy protection.
We may transfer personal data from one jurisdiction to another. Privacy laws vary by jurisdiction, and some may provide less or different legal protection than others. However, Logi-Serve will protect personal data in accordance with the Privacy Shield Program regardless of the jurisdiction in which the data resides.
For users of Logi-Serve's consumer website located at http://www.logi-serve.com, we may employ third-party products and services, including advertisers, that utilize session cookies or track a users IP Address to assist in marketing our products to Consumer Website Users, or service providers who perform functions on our behalf, including hosting our online services to improve your experience, or as otherwise described in our Privacy Policy. Where required by the Privacy Shield, we enter into written agreements with those third-party agents and service providers requiring them to provide the same level of protection the Privacy Shield requires and limiting their use of the data to the specified services provided on our behalf. We take reasonable and appropriate steps to ensure that third-party agents and service providers process data in accordance with our Privacy Shield obligations and to stop and remediate any unauthorized processing. Under certain circumstances, we may remain liable for the acts of our third-party agents or service providers who perform services on our behalf for their handling of Personal Data that we transfer to them.

Data, Security, and Integrity

We employ various physical, electronic, and managerial measures, including education and training of our personnel, designed to reasonably protect personal information from loss, misuse or unauthorized access, disclosure, alteration or destruction. Personal data collected or displayed through a website is protected in transit by standard encryption processes. However, we cannot guarantee the security of information on or transmitted via the Internet.
We process personal data only for the limited and specific purpose for which it was originally collected or authorized by the individual. To the extent necessary for such purposes, we take reasonable steps so that personal data is accurate, complete, current, and otherwise reliable with regard to its intended use.

Access Rights

An individual has the right to access personal data Logi-Serve holds about them as specified by the Privacy Shield Program. An individual may contact us using the information below to correct, amend, or delete information where it is inaccurate or has been processed in violation of the principles. The individual will need to provide sufficient identifying information, such as name, email address, and follow a reasonable process for verification of that information. In addition, we may limit or deny access to personal information where providing such access would be unreasonably burdensome or expensive in the circumstances, or where the rights of persons other than the individual would be violated. In some circumstances, we may charge a reasonable fee, where warranted, for access to personal information.
Recourse

We have established a program to monitor our adherence to the Privacy Shield Program and to address questions and concerns regarding our adherence. This program will include a statement, at least once a year, signed by an authorized representative of Logi-Serve, verifying that this statement is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented, and accessible. We encourage interested persons to raise any concerns with us using the contact information below.
In compliance with the EU-US and Swiss-US Privacy Shield Principles, Logi-Serve commits to resolve complaints about your privacy and our collection or use of your personal information. European Union or Swiss individuals with inquiries or complaints regarding this privacy policy should first contact Logi-Serve using the information below.

For any complaints that cannot be resolved with Logi-Serve directly, Logi-Serve commits to cooperate with the EU data protection authorities (DPAs) and/or the Swiss Federal Data Protection and Information Commissioner, and comply with the advice given by the panel and/or Commissioner with regard to data transferred from the EU and/or Switzerland.
